With thousands of people on these venues getting the 1st time Super Bowl feeling in San Francisco the NFL wants everyone to experience what Super Bowl.is about.

The first step on getting to the venues like Moscone Center is downloading the Road to 50 app simplying. the registration process to be able to participate in the activities like throwing a football, picture at the Lombardi trophy etc..

With Alicia Keys playing also at Super Bowl City leading to Game Day which is 8 hours as of writing this blog..

State of the Nation : Obama's Farewell Writing History

Listening and yet blogging while Barack Hussein Obama delivers his last State of the Nation address, as any sitting President starts on his administrations successes. Watching these speeches on television over the years one thing I've noticed was a change on how the applause was on this congress. The Speaker of the House who sits by the Vice-President seem to be real serious including the Presidential Candidates Republicans on the audience. In saying this, it's the first time I've noticed there were not applauding when the rest are. Over the years as a gesture I remember everyone was applauding or standing.

The President touched a lot of points from the Economy, Unemployment, Auto Industry, HIV-Aids to even Cuba and Bin Laden. Although such audience gesture might indicate agree or disagree, we should looked at the facts of Obama's case. First and foremost he was the first sitting minority as President, he started with one of the hardest part - A Recession, a post Iraq invasion and a climate to redeem trust in the Presidency.

I do want to note the differentiation of then Senator to President Elect Obama as a political figure transcending to a realist commoner leader. From depending Social Security towards his fourth talking point about the future moving forward. Democracy he said goes into a haul distinguishes the difference of the rich and poor  reminiscing his greatest frustration. 

I remember in my year as APEC Youth Representative and the last year of Bill Clinton's Presidency, the similarity of both siting Presidents is this transformation of the true reality of what's going on in America.

Even as a private citizen openly active in youth and political affairs then and now as middle age, you start off with all the ideals that you want to accomplish and over time you augment things, you learn, deviate, mature and transcend your vision towards the real time factors and prevailing conditions.

One ideology I'm proud of is when we started ADLE International in 1998 with the vision of affordability we have endured this vision 18 years after. It's because more than ever what I've seen is that Obama's disparity on the gap between rich and poor really affects a lot of students. This is why till this day we have special promotional prices for textbooks, etc..

Do we make money on this special deals, not really but it's about the vision and mission of what we started and Entrepreneurship is a long development process which one should be looking at the long term results, customer loyalty, fulfillment and   brand recognition. 

As I finish writing this, Obama has just ended his farewell Sate of the Nation. My take, regardless on how history writes about Obama, a salute to a visionary realist the greatest minority President the United States ever had.

Today's online web marketing retail shopping has changed in terms of customer acquisitions and even retention.  Years ago when we were developing our first online storefront

Affordable Books on line there were so many facets in marketing it online. From Search Engine optimizations, ad-words and then emails using 3rd party channels seem to be so many task especially for an individual small operated business.

Then came the power of blogs which was indeed excellent in my case as I do a lot of writings and contributions ater APEC 1997. This blogger profile and our Wordpress were part of the first series which later duplicated and duplicated some of our traffic.

Travel and Drive Time during Training

Drive Travel Time During an Employee new hire training  in California

A few years when we open a small pilot office in California and we had to hire an employee training was essential on the way we were doing business.

Some of the considerations we had to think off was will it be compulsory for that person, where will be held and how far commute will  that person have to do to get to the raining venue.

Looking at Federal jurisdictions for one travel time is not necessarily compensated and training hours may or may not be classified work.hours.

However after doing our research the State of California is more pro employee and supercedes Federal laws.

This meant that since the person is mandated to go to training and travel to the location both travel and training time are work time and must comply with overtime pay as well as most of the time it involves more than an 8.hour day.

A lot of other business owners or even HR generalist even from established companies tend to confuse these as they may have developed travel time policies generally tailored to Federal statutes.

Any small business owner operating in California should  be looking at both Federal and Stare laws to avoid any confusion which could be hefty penalties.

Independent Contractor Brand Ambassadors Mis-Classifications in California Trade Shows

 Major cities in the State of California hold a lot of Trade Shows for promotional and marketing of different companies. Recently there has been a proliferation of these exhibiting companies using third party staffing agencies for booth personnel and other promotional activities during these shows.

These so called third party staffing agencies still employ exhibition staff and brand ambassadors as independent contractors or W9 category which hopefully in the very near future the State of California will require these agencies to convert to W2 or employee categories for their personnel.

Some of the mis-classification violations in these marketing endeavors are these exhibiting companies requiring sales goals to independent brand ambassadors per hour, per day and at the end of these shows.  Sometimes there are so called apps to be downloaded, signed on and promotional codes to be redeem with such goals. In doing this the brand ambassadors are using their personal smart devices and internet data plans to achieved these goals and not even get reimbursed for the expenses.,

In addition, the exhibiting company interferes with contractor schedules when they think a scheduled individual does not hit the so called sales goal within the first hour the show opens. They also would dis-allocate the said person of whom might be scheduled in the next days by relieving him/her of the assignment and replaced by another person which they think might accomplished the said sales goal.

Likewise, the exhibiting company micro-manages the event entirely to their liking in spite of having independent contractors initially contracted to run the event. This extends to asking access and pictures of contractor's daily time and in out sign in sheet as well as sending the brand ambassadors home early when the show is slow even though they were scheduled to work at the end of the show hours. Before the start of the show the so called exhibiting company conducts a training session heavily emphasizing the sales goals required for the project.

In addition, exhibiting companies interferes with rest and meal breaks without even thinking that brand ambassadors are already working 10 to 14 hour shifts without receiving overtime compensation as they are not employee classified.

The sales goals are also micro-manage per hour by way of the exhibiting company communicating every hour, daily, end of the show and two weeks after when said sales goals are achieved or not. Some of these companies will even get back two weeks after questioning the validity of the emails generated integrity and validity.

There are so much violations that entails  in this industry and bottom line the brand ambassadors who just wanted the additional income as independent contractors does not deserved to be in such ordeals.

I will end by citing the excerpts from the National Federation of Independent Businesses with the categorization.

FACTORS: The Common Law Test consists of twenty factors. Not all of the factors need to be present in every case in order to make a determination about classification.The test merely weighs the existence of factors indicating a level of control against those factors showing independence. 1. INSTRUCTIONS a. Employee: provided with instructions from the business regarding when, where and how to perform the work. b. Independent Contractor: decides when, where and how to accomplish the services he or she is providing. 2. TRAINING a. Employee: receives training directly from the employer, demonstrating that the business wants the services performed in a particular manner. b. Independent Contractor: receives little or no training from the business, but rather, hiring is based on pre-existing proficiency or expertise in a particular line of work. 3. SERVICES RENDERED BY THE WORKER PERSONALLY a. Employee: personally performs any assigned duties. b. Independent Contractor: free to hire employees or subcontract tasks. 4. SET HOURS OF WORK a. Employee: works hours established by the employer. b. Independent Contractor: retains the ability to set own hours. 5. REALIZATION OF PROFIT OR LOSS a. Employee: receives pay for time and labor only without realizing any additional gain or sharing in the risk of loss realized by the company based on the worker’s services. b. Independent Contractor: personally stands to gain or to lose economically based on performance of his/her services. 6. TIME REQUIRED a. Employee: usually devotes his/her employment to the business; full-time employment could prevent the worker from engaging in other gainful employment. b. Independent Contractor: does not necessarily work solely for one business and remains free to pursue other projects. 7. DOING WORK ON EMPLOYER’S PREMISES a. Employee: performs services on the premises of the employer to the extent which the nature of the services requires the work to be done on the employer’s premises. If the business has the right to compel the worker to perform services at an alternative specified location, then the level of control remains the same. b. Independent Contractor: chooses where to perform the services. 8. ORDER OR SEQUENCE OF THE WORK a. Employee: required to perform services in the order set by the employer. b. Independent Contractor: retains the option of deciding the sequence in which the work is performed. The Common Law Test 2 In 2006, the IRS issued a revised test that consolidated the 20 factors into 11 factors, divided into three groups: (1) behavioral control, (2) financial control, and (3) the type of relationship between the parties. Functionally, this new test is very similar to the 20-factor test. IRS Publication 15-A lists the factors and is available at www.irs.gov/publications/p15a/ar02.html#d0e346.

 9. CONTINUING RELATIONSHIP a. Employee: a continuing, non-sporadic relationship exists between the business and the worker. b. Employee: may hire assistants only under the direction of the employer. b. Independent Contractor: free to hire, supervise and pay additional assistants or subcontractors as necessary. 11. INTEGRATION OF THE WORKER’S SERVICES a. Employee: services are integrated into the daily success and operation of the business. b. Independent Contractor: services provided do not substantially affect the overall success of the business. 12. ORAL OR WRITTEN REPORTS a. Employee: submits regular reports to the employer for whom the services are being performed. b. Independent Contractor: accountable for end results only and not necessarily required to provide regular reports. 13. PAYMENT METHOD a. Employee: paid by the hour, week or month. b. Independent Contractor: paid by the project or on a straight commission. 14. PAYMENT OF BUSINESS EXPENSES a. Employee: the business usually pays expenses for the worker. b. Independent Contractor: pays for own business and traveling expenses. 15. FURNISHING OF TOOLS AND MATERIAL a. Employee: receives tools and equipment from the employer. b. Independent Contractor: provides tools, equipment and materials. 16. SIGNIFICANT INVESTMENT a. Employee: depends on the continued success of the business without taking on any investment in the working facilities or equipment. b. Employee: restricted, either explicitly or effectively, from providing services to several businesses at once. b. Independent Contractor: free to provide services to multiple, unrelated businesses at the same time. 18. AVAILABILITY OF SERVICE TO THE GENERAL PUBLIC a. Employee: provides services to only one business. b. Independent Contractor: offers services openly to the general public. 19. RIGHT TO FIRE THE WORKER a. The greatest strength of Spot Hero which it should focus on a city like San Francisco is affordability and living to the concept of a guaranteed reserved parking spot with its pool of partner garages.

At the recent San Francisco Auto Show this last Black Friday madness, the company showcased for the first time which gave the venue of interfacing with new and current user customers. From hereon, my recommendation is living to the promise of continuously improving it's technology for its App, make the application. as  convenient even for consumers starting on smart phone devices and the great niche live to the promise of "Guaranteed Reserved Parking Spot" .  This promise will entail a lot of work and customer service but in the end a huge metropolis like San Francisco may be this company greatest potential having presence in 14 major cities compared to San Francisco based luxe valet of whom is only in 3 cities.

More wishes and as always this is the talent of young entrepreneurs being creative and consumer driven in focus.

Integrating success in a small business

Living with a chronic illness and being disabled in times like today are not fun. Each day the stress pounds on how one would be surviving considering that the money coming in is not even enough.

What's worse is that some benefits from agencies are literally withheld or denied because of the lack of the money. Of course, there would be excuses about administrative requirements but the bottom line is that the poor, ill and needy are the ones who are experiencing the repercussions of the system.

The main goal must be to check and balance in government and agencies. There should be agencies that can really understand the real problems of the needy as to the vast administrative requirements of the law. Is there such a thing as destiny and belief

Both words seem to have a very much expanding menaing. However, growing up simplr has a basic relevance to this words. It really depends on how we are brought up, to what beliefs and what cultures we were shown.

In certain cases like myself, religion played an important part of life. It was very synonomous that when times get tough and there are no more perceived ways to counter a problem or situation, prayers and belief in God plays an important part in the ordeal or process.

Growing up with ties to science and technology also seemed a little confusing at first. There were times I have to think if there was a logical meaning to the belief in terms of science. There were times that I have asked that is the belief not just a primitive way of supertitious beliefs? But then as time went by I discovered no, faith does work and it is indeed integral to one's destiny.

Maybe, there can be a lot of discussion points about this subject. However, as the purpose of blogging is mere personal expression, I want to share that personally faith, belief, and religion does work with my personal fate and destiny. This is the essence of the meaning of why personally I believe that there is such a thing as destiny and belief.

Dream the Impossible As It Will Be Possible

As a child in the 80's, I used to hear the song, "Impossible Dream" and love to watch "Mission Impossible".

Years and decades from now hopefully if this blog is archived and preserved, it will show how people like us of giving importance on the youth while undergoing the challenges that went on with it truly endures.

The realities of stories about lives is always focused on the present. So regardless if someone has really done a tremendous job and example for society what they are before finally getting that credit most of the time writes their own history. So when this project was started together about memoirs of past, present and future endeavors of my beliefs for the youth, this was the insurance of what memorable memoirs should be about.

Of course there would be a lot of stories from many sources good or bad about one's past lives and achievements but having more verifiable data sources will more validate such stories. The main point is that in all generational divides, it can be stated that giving the youth the right direction, preparation, recognition and importance always shapes what the future will bring towards success.

And who knows, just maybe as in democratic politics, the youth will be well represented in the executive, legislative and judicial branches of governments for years and decades to come. Even cabinets and houses in governments will permanently appoint a specific youth representative.

Then a new era in democratic ideals and change will indeed be achievable in rich and poor nations.

Realities of small businesss owners and self employed individuals

Emails climbing to thousands, phone calls and messages non-ending, chores getting longer, finances to account needing more attention, clamoring cash flow sources for paying bills, etc.., These are just some of the enormous routine work schedule that a solo self-employed individual or entrepreneur goes through upon a sudden illness, emergency need, or after days or weeks of not being able to work.

As the old saying states, this would not have been an issue if there was a delegation of task, other people in the team and or an action plan in case. Yet inspite of the realities and educational aspects sometimes humans under estminate true situational factors. A lot of times, the over lying circusmtance is always equalled to a certain generalized solution. Often times, the gaps between a start-up, just opened up, or purely run solely due to cost cutting measures are not always pyschologically considered in the equation.

Take for example the current global economic recession which has literally imperilled a lot of the entrepreneur's survival resources. The chain and effect syndromes that underline and intertwine with the actual business challenges and problems are another.

Yes, it is agreeable to be guilty of not being able to accomplished the much needed goals and chores. However, responsibility is another thing. Nobody would risk a business or income opportunity. In order not to anyhow a person's health and well being comes first and foremost. Without the person's ability to protect it's own self and it's immediate circle, work will never be possible at all. Hence, it the reason why humans can always start anew regardless of any circumstances.

How Do You Make The Difference through Believing

Just like when I took this journey of years of being in low profile and suddenly come out to support change was what this is about. Taking such a journey is not always easy as there are a lot of people that makes politics as a business.

But through mere faith, hope, love of community and society will one's determination for passion to create the change should not stop anyone who wants to take the same journey.

The point of all of this somewhere back in time as I have personally experience, is the passion to lead, inspire and show people that it is indeed possible.

From a a mere change of cash from selling an old car and starting in a garage. The main difference was that my family, my community and most of all my government believed of this very ideals back then. In spite of the culture among young people of not having enough experience and coming from a middle class family, it was a mere process of replication, sustainability and inspiration from the very grassroots level of society.

I have always believe that putting the community and society over and above your own amibitions leads to greatness. In that creates the spark of motivation from nothing towards growth and opportunity. I had to create a speaking voice for world leaders if so needed as regardless of race, belief and age everyone has the right towards free trade and opportunity.

When you take such a journey it is very hard as it compromises a lot even one's future, safety and opportunities. But then the hard part of faith activism is that the feeling of achievement is very outpouring. Through that outpour creates more motivation from someone with that fire in their belly to create a more better impact for the greater good of society.

Nowhere in my life from that garage that I saw myself one day speaking in behalf of the greatest innovative technology young entrepreneurs in the asia-pacific region. I also did not even see myself being part of writing economic programs and even meeting world leaders. So what the greatest lesson of this online journal is a testimony that compassionate dedication towards humanity is possible.

My goal today is help spread this testimony and hopefully the next generation of young leaders. Together we march to greatness because going back to the one's civil liberties is the only way that will create the healing of an economic recovery.

When are you going to acknowledge the need when one is gone as in the past.

When people die so does their ideals and their passions. Then we have this memorial services talking about the pasts and or whatever contributions a dead person may have at some point done or accomplish.

Through the years of giving the best legacies of my closest relatives always memorable, no matter how grandeur or small I have tried, people seem to wonder why I still wept? This was because being close to these very people who have influence my life so greatly I knew they have their own way of ADD. It's hard to being some kind of historian and keeper of family secrets as you also know what the frustrations were about.

Just like the closest women in my life came the three important things for them such as Faith, Love and Family. Then came the common denominators of community, society and entrepreneurship. I was always wondering why they made genealogy and the church as part of everyday or usual converations. But on the other side of the circle, they knew what people were talking about. Some people talk about thriftiness, strictness, discipline, and or being them being too shrewed to get rich.

So as a child, it makes you really wonder what's the real truth and the quest to find the answers. Then slowly I understood how it all connects so that in the end the spirit of giving back can be returned. The one great thing I have learned in my own quest is that one should be able to really express the true goals so that later on people will have some kind of historical reference to refer to back in time.

This is the spirit behind why I was so deeply fascinated in writing an e-book through "Memories of an APEC Youth Representative". So that together with this and other facts of evidence, people can some day refer to and what, who, and how was the real other side of me and the women behind the circle. I was the only one who can be the communicator of the histories that they wanted to express.

Because the expressions were so private that more than ever people did not really get the real message. Thank God I was the creative one, imaginative, and able to write in some way as otherwise these expressions will just stay beneath me like what had stayed beneath them.

I guess the only setback I have personally is that of all the adversities I have endured with these intentions I hope I can simply enjoy the fruits while am still here. As when I'm gone it will not make sense because there is nobody like me to past it on to. Yes, the chain breaks here because the real inner stories of the once mighthy religious De Leon family ends with me.

I've Said My Pitch, Better Make Your Decision

Being multicultural in terms of ethnicity, "patience" has been a big virtue in my life as an entrepreneur. After all these years, I for heaven's sake know what sacrifices are all about. Sometimes people doubt people but even before we judge a person, we must indeed ask our inner selves how deep do we really know a person.

Just like Madonna's material world, we can't judge a person just because of what you see now. Intelligently, had you really dug deeper into a person's past if whether he has really indeed accomplished the past successes he said he was able to do before?

In a culture where relationship matters, it is very important for us to state what we really mean as it can make or break a deal. Our honor, our dignity and our ethics is on the line. Why for all this time, after all the heartaches, challenges and sacrifices did we re-appear just because we wan't popularity? That is past as am over that complex long ways time and memorial. I did what had to be done because I believe in the person or person's I honor and trust. Trust is a very important virtue as it's like a knife that will do harm if we played around with it.

In spite of the harassments and embarassments we have still welcome our detractors with open arms. After all, this is a new day and there are no more mavericks right now as we are struggling and we need your help for us to go through the turbulence. It is just a simple "yes" or "no" which would be nice to hear from if your going to support our business or not?

What my commitment is the legacy of what this is about. I am not in politics but just a struggling home based micro enterprise whom had been clamoring for your help and support all these months. The plan is written, the point person is known and the best way to move further is to work with the point person. Then together we heal, together my voice and my face will help inspire to motivate and tell my story. Thus, this will acknowledge to the world that change and the mathematical complexity of this is simply being an illusion of fear. I've said my pitch, better make your decision as then it might it be too late before the secret is given to others.

In all this time since the dot.com and over the wall street years investors gauge on earnings and revenue by purely making forecasting assumptions. Just look at what happen to the analyst who just admitted to be the greatest ponzi scheme of all time.

But regardless of what and how they look at similar micro enterprises like us, they never see potentials in terms of revenue growth. It can be mere simply colored graphs using microsoft excel data for basic understanding by all parties. But the idea is based on historical data which to me seems to be a more accurate way of predicting a true rate of return. But no, it was all about fico scores, credit ratings and bankers ratios which is why this economics is in chaos today.

It you get a few product category which is more focus, deliberate on the strategy and gauge the way of the founders delivery to the target market should at least ignite that inner intellectual part that this is "hot". It does not take fame gurus and names in the community if one is really an good investor.

The ability to use a commodity as a productized strategy generating multiple income streams should be how an emerging start-up should be classified. Product category mix varies on the evolving business climate and conditions. The entrepreneur's ability to immediately shift and add other streams to stay afloat should be rewarded than snob.

Let us forget of hoping for another Darwinism as there is no other Microsoft or no other Google. These companies and their verticals have still big growth potentials in their own niches. What we need to look for are the new candidates towards the places where such companies use to be, not a service model, social and community consciousness, sustainable growth but still focuses on using a basic product as commodity.

The more we procrastinate when the avenues are already open and conducive might be too late. Why, it's because not all the great innovators on such philosophies are still going to emerge having the past, the present and the future.

Thanks to our allies and people that have continuousy supported us through thick and thin, our vision and mission at least have reach significant milestones today.
